In our rapidly aging society, this study provides measures to revitalize sports for the elderly and create jobs, and the sports rights are guaranteed based on Article 10 of the Constitution, and specific guarantees are guaranteed by the Framework Act on Social Security, and detailed guarantees are guaranteed by subordinate laws. In this paper, we carefully analyzed only the laws related to the elderly among the Social Security Basic Act and sub-laws in which the elderly's daily sports are actively progressing, and sought legalization measures to revitalize the elderly's daily sports. According to a review of the Elderly Welfare Act, the Low Birthrate and Aged Society Act, the National Health Insurance Act, and the Elderly Long-Term Care Insurance Act, most of the relevant laws stipulate the importance of elderly health, but specific measures or activities are missing. In other words, this is a lack of legislation, and active legislation by the administration or legislature is required. In conclusion, in order to overcome this reality and promote the daily sports of the elderly based on the constitutional sports rights, a plan to revitalize daily sports can be derived as follows. First, it is necessary to reflect the sports rights of the elderly as a basic right under the constitution throughout the Framework Act on Social Security. Second, it is necessary to legislate the contents that reflect the activation of daily sports so that the provisions related to maintaining and promoting the health of the elderly raised in the Framework Act on Social Security can be realized. Third, it is necessary to legislate that sports for all can be applied as insurance under the Social Insurance-related Social Security Act, and experts trained in sports for all should be fostered to create jobs for the right to work in this paper.
