Since sports are activities that involve a lot of risks, no matter how much safety devices are equipped in the field and safety education is conducted in advance, the occurrence of accidents cannot be fundamentally. Therefore, it will be necessary for both perpetrators and victims of sports accidents to come up with appropriate measures after the accident. In particular, sports insurance should be an appropriate guarantee to protect not only victims but also perpetrators because the perpetrator of sports accidents is only an inevitable factor due to the risks involved in sports rather than a true perpetrator. Insurance systems for professional sports are being developed and established not only abroad but also in Korea to some extent, but sports for hobbies or club activities by the general public are not subject to professional sports insurance products, and even if they are, the insurance premiums are too high for the general public. If so, sports activities of the general public are eventually protected by general injury insurance. However, in the case of general injury insurance, one of the reasons for not paying insurance money is to be injured or killed while professional climbing, scuba diving, hang gliding, and skydiving through club activities. Therefore, if a person is injured or dies while participating in club activities, it is highly likely that general injury insurance will not be protected. Recently, the Supreme Court sought compensation by expanding the scope of recreational activity accidents by restrictive interpreting the 'club' under the terms and conditions of general accident insurance. Sports activities that have a profound impact on not only mental and physical health and stability but also social interaction are essential factors in modern society, so the safety of sports should be guaranteed first to improve this quality of life. Therefore, not only the accidents of professional sportsmen but also the sports accidents in the public should be protected, especially in the case of one-time recreational activity, it should be protected by exerting the meaning of operation under the current system. Therefore, this thesis examined the validity of the disclaimer, and how to interpret the disclaimer and risk exclusion reasons of general injury insurance in order to protect sportsmen under the current insurance system.
