이 연구는 합법사행산업 중 경주류로 분류되는 경륜․경정과 경마의 온라인 발매제도 도입을 위해 2년 전에 개정된「경륜․경정법」과 최근 개정된「한국마사회법」의 내용을 비교 고찰하고 온라인발매 활성화를 위한 정책 제언을 하는데 그 목적이 있다. 이를 위해 두 개정 법률의 내용을 온라인 발매에 대한 주무부처의 관리감독 강화, 청소년 접근 및 타인명의 도용 차단, 이용자 보호 및 과몰입 예방 강화, 온라인 불법 경주류 확산에 대한 단속 및 처벌 강화의 4가지 영역으로 나누어 고찰하였으며 그 결과는 다음과 같다. 첫째, 경주류 온라인 발매 도입을 위해「한국마사회법」과「경륜․경정법」내용은 4가지 영역에서공통점이 많은 것으로 나타났다. 둘째, 온라인 경마에 있어 주무부처의 시행체에 대한 관리감독과 책임성은 온라인 경륜․경정에 있어주무부처의 시행체에 대한 관리감독과 책임성에 비해 대폭 강화되었다. 셋째, 온라인 경마의 매출 총량(경마 매출 총량의 10%)은 온라인 경륜․경정의 매출 총량(경륜․경정매출 총량의 50%)에 비해 낮게 설정되어 온라인 매출 비중이 크게 축소되었다. 넷째, 온라인 경마의 회원가입 제한연령(만 21세 미만)과 가입방법(대면)이 온라인 경륜․경정의 회원가입 제한연령(만 19세 미만)과 가입방법(대면․비대면)보다 훨씬 엄격해졌다. 향후 온라인 발매 활성화를 위한 정책 제언으로는 유튜브를 통한 경주실황 중계, 현행 온라인 구매상한을 5만원에서 10만원으로 조정할 것을 제시하였다.
The purpose of this study was to compare the contents of the recently revised「Korean Racing Authority Act」and the revised two years ago「Bicycle and Motorboat Racing Act」to introduce an online betting ticket sales system for bicycle & motorboat racing and horse racing classified as racing type among legal gambling industries and to make policy suggestions. To this end, the contents of the two revised laws were divided into four areas: strengthening the management supervision of the relevant ministries for online betting ticket sales, blocking youth access and theft of other people's names, strengthening user protection and excessive immersion prevention, and cracking down on and punishing online illegal racing. First, it was found that「Korean Racing Authority Act」and「Bicycle and Motorboat Racing Act」 have a lot in common in four areas to introduce online betting tickets sales. Second, the management supervision and responsibility of the relevant ministry in online horse racing has been greatly strengthened compared to that of the relevant ministry in online bicycle & motorboat racing. Third, the total sales cap of online horse racing (10% of total horse racing sales cap) was set lower than the total sales cap of bicycle & motorboat racing (50% of total bicycle & motorboat racing sales cap), greatly supervising sales of online horse racing more thoroughly. Fourth, the age (under 21) and method of membership (face-to-face) in online horse racing have become much stricter than the age (under 19) and method of membership (face-to-face and non-face-to-face) in online bicycle & motorboat racing. As a policy to revitalize online sales, it was suggested to broadcast racing live through YouTube and raise the current online purchase limit from 50,000 won to 100,000 won.
