본 연구는 지적장애인과 위험에 관한 부정적인 의미에 대한 재해석의 필요성을 조사하고, 위험 에 관한 새로운 관점을 도입하고 있는 영국의 적극적인 위험 감수(Positive Risk Taking) 정책을 살 펴보고자 한 것이다. 이를 위해 영국 잉글랜드 지역의 지방정부 5곳의 공식문서 등을 중심으로 분 석했다. 성인 지적장애인과 관련한 적극적인 위험 감수 정책의 원칙, 지침, 절차 등을 분석한 결과, ‘이용자의 삶에 대한 선택권과 통제권’, ‘누구나 위험을 감수할 권리’, ‘자신의 선택과 책임에 대한 함의 이해’, ‘위험으로부터의 안전’ 등의 원칙과 ‘정보에 근거한 선택’, ‘케어 의무’, ‘활동의 결과가 좋지 않을 경우’ 등의 지침이 확인되었다. 또한 위험조사 및 위험관리의 체계적인 절차를 파악할 수 있었다. 이를 통해 영국의 적극적인 위험 감수 정책은 지적장애인이 자신의 삶을 선택하고 통제 할 수 있도록 지원하기 위해 위험과 안전 사이에 균형을 맞추는 것임을 알 수 있었다. 이 연구는 국내 정책 및 서비스에서 지적장애인의 실질적인 권리 보장을 위해서는 위험에 대한 부정적인 인 식이 전환되어야 함을 밝히고, 위험과 안전의 균형 가능성을 제시했다는데 의의가 있다.
The purpose of this study is to survey the necessity of re-interpretation of giving negative meaning on a person with intellectual disability and risk, and to know a Positive Risk Taking Policy in England who has adopted new concept on risk. For the study, four regional government's official documents in England were analyzed. Based on the analysis of principle, guideline and process of the Positive Risk Taking Policy related with an adult intellectual disability, several principles such as 'Selective and control rights on the life of users', 'Rights for anybody to take risk', 'Understanding on the implication of individual selection and responsibility' and 'Safety from risk'; and other guidelines such as 'Informed choice', 'Duty of care' and 'Guideline in case of something wrong' were founded. Also a systematic process for a risk assessment and management were founded. Based on the findings, it was proved that the Positive Risk Taking policy in England was to balance risk and safety in order to support for a person with intellectual disability to select and manage their life. This study was meaningful that it prosed changing negative concept on risk in Korean policy and service for practical rights protection of a person with intellectual disability, and presented the possibility of balance of risk and safety.
