대한민국은 지방정부와 중앙정부로 구분 한다. 따라서 지방정부와 중앙정부는 각각의 영역을 가지 고 있다. 다른 말로 표현한다면 지방에서 해야 할 일과 중앙정부가 해야 할 일로 양분되는 것이다. 대한민국의 영토가 협소한 탓인지 대한민국의 국민들은 공동주택이라는 일명 아파트에 대부분이 모 여살고 있다. 그런데 사람들이 모여 살다 보니 작은 사회를 구성한다. 작은 사회에서도 인간의 일상 은 이루어지고, 크고 작은 사건사고가 빈발한다. 결국 공동주택이라는 사회에서 벌어지는 각종의 사건사고는 수없이 많은 분쟁을 야기한다. 분쟁이 발생하면 해결을 해야만 하는 바, 지방에는 지방 분쟁조정위원회가 중앙에는 중앙 분쟁조정위원회가 해결사 역할을 자임하고 있다. 그러나 지방에서 발생한 분쟁을 중앙에서 해결하면 안 된다는 규정은 없다. 다만, 지방의 분쟁을 중앙에서 해결하기 위한 절차가 복잡하고 까다롭다는 문제가 있을 뿐이다. 따라서 지방 분쟁조정위원회의 기능을 향상 시키거나 폐지하여 공동주택 입주민의 편의를 향상시키 고, 권익을 최대한 보장해야 한다는 사명감으로 중앙 분쟁조정위원회의 기능을 개선해야 한다는 주장 을 하는 것이다. 우리 나라는 특별히 중앙이라는 곳이 없다. 단지 수도권과 지방으로 구분하여 부르고 있을 뿐이다. 그래서 수도권은 중앙 그 밖의 지역은 지방이라고 구별을 하는 것은 아니고, 정부 또는 지방자치단체 를 기준으로 중앙정부 소관의 업무일 경우에는 중앙, 지방자치단체소속의 업무는 지방 이라고 구분하 여 일컫는 것이 보통의 중앙과 지방이다. 지방의 공동주택에도 사람이 살고 그러하기에 갈등과 분쟁 이 발생되고 있다. 지방의 공동주택에서 발생되어지는 분쟁에 대하여 지방분쟁조정위원회의 대응이 미숙하고, 사람들이 불편해한다. 한마디로 그들의 갈등에 대한 분쟁을 하소연하기가 너무 힘들다는 것이다. 그러면 어떠한 방안을 강구하여야 하는 지에대한 검토가 본 연구의 목적이며, 어떠한 대안을 제시할 것인가가 본연구의 최종 정착지이다.
