본 연구는 서울특별시 25개 구청을 중심으로 장애인 관련조례에 대한 현 황 및 실태를 살펴보았다. 그 결과 장애인 조례가 많은 구(중구, 양천구, 영 등포구등)도 있었고 없거나 적은 구(금천구, 동대문구, 중랑구, 성동구, 광진 구)도 있었으나 각 구의 장애인 조례는 중구의 “지적·자폐성 장애인 지원 에 관한 조례”를 제외하고는 비슷한 내용이었다. 그것은 조례의 제정범위 가 “법령의 범위 안에서”로 제한됨으로 제정권에 대해 제한을 받아왔으 며 각 지방자치단체의 형평성 문제와 장애 유형에 따른 형평성의 문제에 기인하기도 한다. 개선방안으로는 장애인 관련조례의 제정기준과 규율 범위를 넓히고 장애 인 유형별 지원 조례를 만들어 장애인 소수의 의견이라도 이를 반영하여 그 특성에 맞는 조례를 만들어야 할 것이다. 또한 장애인의 교육과 교육환 경을 개선하여 장애인 스스로 비장애인과 경쟁할 수 있도록 법적 근거인 조례와 예산의 재원을 마련하여야 할 것이다.
This study was to investigate the present state and actual situation of disability-related ordinances centered on the 25 Gus in Seoul Metropolitan City. As a result, there were Gus with many disability-related ordinances like Jung-gu, Yangcheon-gu, and Yeongdeungpo-gu, etc. On the contrary, there were Gus without the disability-related ordinances or a few disability-related ordinances like Geumcheon-gu, Dongdaemun-gu, Jungnang-gu, Seongdong-gu, and Gwangjin-gu, etc. The disability-related ordinances in each Gu had similar contents expect the "Ordinance on the Support of Intellectual·Autism Disabled" in Jung-gu. It was restricted in the ordinance-making authority because the range of enactment of ordinance was limited as "within the extent of the law's application". Furthermore, it was caused by the matter of equity in each self-governing body and the matter of equity in according to the types of disability. For the improvement plan, it needs to enact ordinances fit for the properties by extending the standard of enactment and range of discipline for the disability-related ordinances, enacting each type of support ordinances, and by reflecting the disable's minority opinions. In addition, it requires the preparation of resources in budget and ordinance as legal basis in order that the disabled can compete with the non-disabled on their own by improving the education and educational environment for the disabled.
