There are about twenty thousand of unregistered immigrant children for
the school age, aged from 6 to 18, who are staying in Korea. With a
long-term view, the number of immigrant children can be predicted to
increase more and more. Accordingly, this study focused on grasping actual
conditions and problems in the whole rights of unregistered immigrant
children and trying to find measures for them, on the basis of UN
Convention on the Rights of the Child.
According to results of the study, the systematic measures for securing
the rights of unregistered immigrant children are as follows. First, a child
who was born in Korea shall be entitled to stay in Korea as the legal right
of the unregistered immigrant child. In terms of Korean population
structure, it is very necessary to accept children who were born in Korea
and it is possible to foster them to be great for Korean society and national
interests according to direction of national policies. Second, as solutions for
rights of unregistered immigrant children, measures should be taken such
as a right to be educated, a right to be protected, right to live with
parents, a right to be treated without discrimination, a right to social
welfare, a right to stay and so on.
