인권은 매우 보편적 개념으로서 그 누구에게도 감히 침해되어서는 안 되는 천부권으로 서 어떤 능력이나 자격을 넘어서 그 자체로 인정받아야 한다. 이는 장애아동에게도 마찬가 지로 똑같이 적용되어 마땅하다. 본고는 장애아동의 인권 및 권리조항들을 포함하고 있는 국제협약과 선언들을 조망함으 로써 국제적 수준에서의 노력들을 파악하였고, UN장애인권리협약에 나타난 장애아동관련 조항들의 국내이행 수준을 점검해보았다. 그 결과 우리나라에서의 많은 노력과 시도들에도 불구하고 여전히 상충되거나 미흡한 부분들이 존재하고 있음을 확인하였고, 그에 따른 법제도적 측면의 개선이 필요함을 인식 하였다. 또한 법제도적 내지 정책적 측면에서의 아동의 권리옹호체계 확립을 위한 이념적 기틀로서의 자기결정과 정상화원리를 논함으로써 향후에도 장애인정책기조의 핵심이념으 로서 결코 간과되어선 안 될 것임을 재확인하였다.
The human rights is very universal concept. Nobody can't be able to infringe daringly. It is natural. Also it is not what kind of ability or meaning of qualification. Recognition must receive with it oneself. This must be applied like exactly even in the child with disabilities. The research which sees tried to observe international conventions and the declarations which include the human rights and a right of the child with disabilities. Grasped the efforts from international level hereupon consequently. And the inspection where the child with disabilities relation provisions which appear in UN-CRPD should how have been come true from Korea tried. The result, there were many efforts from Korea. But still the parts which are insufficient are many. The law or the improvement of the institutional side recognized is necessary. Also the law or as the ideological crux for the right support systematic establishment of the child from the politic side there is a own decisive and normalization principle. These do core ideology of the policy for people with disabilities which in future is important.
