발달장애아동의 자기결정권에 관한 연구

본 연구는 발달장애아동의 자기결정에 대한 논의를 통하여 발달장애아동의 자기결정권을 신 장시키기 위한 방향성을 모색하고자 했다. 발달장애에 대한 사전적 의미, 법제적 의미에 대한 변화를 모색하고, 인권, 사회복지 현장, 심리학, 특수교육에서 적용되는 자기결정의 개념을 통해 발달장애 아동의 자기결정에 대한 정의를 고찰하였다. 더 나아가 본 연구는 사회적 차원에서 장애 패러다임의 변화와 자기결정과 관련된 법적 권리를 발달장애아동에게 적용해 보았다. 발 달장애아동과 자기결정에 관한 전환, 고용, 장애정도, 연령차이, 지역차이에 관한 문헌을 통하여 자기결정권 신장을 위한 보편성을 알아보았다. 이러한 내용을 바탕으로 발달장애 아동이 자기 결정권을 누리기 위해 다음과 같은 과제들을 제시하였다. 발달장애아동에 대한 개념은 점진적 으로 발달 가능한 존재로 변화되어야 사회적 인식 제고가 가능하며, 제도와 개입은 발달장애 특성에 맞추어 조정되어야 발달장애아동이 자기결정권을 향유할 수 있을 것이다.

영문초록

The purpose of the present paper is to discuss the issues of self-determination pertaining to children with developmental disabilities so as to guide the provision of the support to enable them to become more self-determined. More specifically, the following topics are covered in the paper: the dictionary, clinical, and legal definition of developmental disabilities and self-determination, the application of paradigm shifts in disability and the rights to self-determination to the filed of developmental disabilities, and empirical studies regarding the influence of transition, employment, severity of disability, age, and geographical region on the capacity for self-determination. In the light of discussion, several suggestions are proposed to foster the rights to self-determination for children with developmental disabilities. These included increasing social awareness for the evolving capacity of children with developmental disabilities and tailoring intervention and policy according to the specific and individual needs.
